Subdividing lots in Lake Bonavista affects lake access and other benefits

We received this notification from the Lake Bonavista Homeowners Association that may be important for you or your clients.

The notification clarifies the issue of Lake Bonavista Homeowners Association membership, including lake access, when lots are subdivided.

Excerpts from the notification include:

“Lake Bonavista is a planned community built around a private lake with limited capacity and access is limited to LBHA members. LBHA Membership is governed by the Articles of Association and is limited in number. Membership does not automatically expand when a parcel of land is subdivided or redeveloped. Municipal zoning changes, land use bylaws, or development approvals granted by the City of Calgary do not alter, expand, or create eligibility for LBHA Membership.”

“Subdivision of an existing lot does not create eligibility for an additional LBHA Membership.”

“The newly created parcel that is not designated will not be eligible for LBHA Membership or privileges. This includes lake access, voting rights, and all other Membership-related benefits.”

“The LBHA recommends that listing remarks and buyer disclosures clearly state when a property does not include LBHA Membership or lake access.”
