Updated CREB® Rules now in effect

In last week’s CREB®Talk, members were notified of amendments approved by the Board of Directors to the CREB® Rules. The board, the Practice Governance Standing Committee (PGSC) and Member Practice staff work together to support clear, understandable rules that elevate the profession.

In summary

These changes include modernizing the rules that govern the formal complaint process. Some of those changes are highlighted below: 

Clarify that respondents must successfully complete any educational requirements directed by a hearing panel.

Clarify how long CREB® will retain hearing proceedings. 

Confirm that a show cause hearing will be conducted through the submission of documents unless the hearing panel directs that it be held in person. Only in-person hearings will be digitally recorded. 

Clarify the responsibilities and authority of the investigating team and confirm that a decision to charge a member or dismiss a complaint is not appealable.

In addition, the Board of Directors has approved an amendment to the CREB® Rules preamble to clarify that amending the CREB® Rules is a governance responsibility. As CREB® staff cannot change the rules in response to member requests, members will be directed to the PGSC suggestion form to submit proposed rule amendments.  

Professional Standards Assurance Team (PSAT)

Disputes between members that cannot be resolved at the broker level and involve potential contraventions of CREB® Rules, Bylaws or the REALTOR® Code may be submitted to CREB® for review. The Professional Standards Assurance Team (PSAT), consisting of REALTOR® members, investigates complaints and serves as hearing panelists in this peer-to-peer process. Part V of the CREB® Rules outlines the steps followed when investigating complaints and making decisions. 

The latest updates to the CREB® Rules primarily affect Part V and reflect the amendments approved by the Board of Directors that take effect today.
