Needless to say, this is highly disappointing and something we intend to defend vigorously against.
Unlike the AREA lawsuit which started with a Statement of Claim, this matter was commenced by way of an Originating Application. The two procedures are different. The Statement of Claim begins an action to resolve disputed facts, which is the traditional form of a lawsuit, whereas an Application is used when the court is asked to decide a legal issue where the facts are generally clear and the court is being asked to decide how the law applies.
The latter is what CREB® received on the action around the election. We are now moving through next steps with our legal counsel, and we will continue to provide CREB® members with more information as we can.
