AREA condominium form updates

 AREA recently updated provisions within its condominium contracts and schedules, as described in the table below. 

The table uses Clause 8.2 from the Residential Resale Condominium Property Purchase Contract as an example; however, the complete list of affected forms and the applicable clause numbers is provided below the table. 

The changes are shown in red in the middle column, with a brief explanation in the right-hand column.

What this means 

(4) copies of the following, to the extent that they exist:

h. a statement from the condominium corporation setting out the criteria used to determine unit factor allocation (if not already addressed in the information statement);

 This statement has been removed and is no longer required, if applicable, as part of the Condominium Documents.

(6) copies of reports prepared for the condominium corporation by professionals since the date of the most recent reserve fund study, including professional engineers but excluding reports requested and obtained by the corporation’s legal counsel in relation to actual or contemplated litigation;

 

 (6) copies of reports prepared for the condominium corporation by professionals since the date of the most recent reserve fund study, including professional engineers but excluding documents that are subject to legal privilege reports requested and obtained by the corporation’s legal counsel in relation to actual or contemplated litigation;

Clarifies the exclusion of documents that are subject to legal privilege.
 New content

(10) any technical analysis prepared under section 21.2 of the Act and Part 3.2 of the Condominium Property Regulation;

 

 Added to include documents not previously covered.
 New content (11) any Notice of Proposed Chargeback or Statement of Chargeback served on the seller, if applicable;  Added to include documents not previously covered.
